OUTCOME: Felony Charges Dismissed
The ex-wife of Mr. Jean-Pierre accused him of breaking into her house and assaulting her boyfriend with a pipe. The police charged Mr. Jean-Pierre with Burglary in the First Degree, Robbery in the Fir ... st Degree and Assault in the Second Degree. After a complete and rigorous investigation, it was discovered that Mr. Jean-Pierre’s wife had an extensive history of mental illness and had confessed to fabricating Mr. Jean-Pierre’s involvement. Confronted with the defense’s evidence, prosecutors agreed to drop all the felony charges against Mr. Jean-Pierre.
OUTCOME: Manslaughter Charges DISMISSED
While operating her motor vehicle, Ms. Lannon struck and killed a pedestrian. The police arrested Ms. Lannon and later obtained a search warrant to draw blood and thereafter conducted blood tests. The ... blood tests found two prescription medications in her blood; as a result Ms. Lannon was charged and indicted for Vehicular Manslaughter, Vehicular Assault and Driving While Abilities Impaired by Drugs. Mr. Brocato upon being retained by the family conducted a thorough review of Mr. Lannon’s medical history and discovered she had suffered from seizures in the past. Mr. Brocato then obtained the services of experts in the fields of seizure disorders and toxicology. Mr. Brocato was able to prove that Ms. Lannon’s abilities to operate her motor vehicle were not impair by drugs that the prescription medications found in her system where within therapeutic levels and she had in fact suffered a seizure causing her to lose control of the motor vehicle. As a result the District Attorney’s Office dropped the Charges.
