Richard B. Lumley

Rich Lumley represents individuals and businesses in complex commercial, real estate, trust and estate, and employment disputes. He has in-depth experience representing clients in state and federal courts, as well as alternative dispute resolution venues.
Rich provides guidance to clients on critically important issues impacting their businesses and lives. Rich values client collaboration and enjoys formulating legal strategies to efficiently achieve desired outcomes. He creates practical solutions for clients that are sensible from a business and personal perspective.

Rich attended Northeastern University School of Law in Boston, where he was a public interest law scholar, a member of the Northeastern University Law Journal, and a member of the School’s Admissions Committee. As part of his program Rich completed full-time internships with the Hon. Marianne Bowler at the U.S. District Court for the District of Massachusetts, Northeastern University’s Office of General Counsel, Orr & Reno P.A., and the Massachusetts Development Finance Agency.

In addition to his litigation experience, Rich has served as an honors fellow with the U.S. Environmental Protection Agency’s Office of General Counsel in Washington, D.C., focusing on ethics and political activities law. Rich’s legal experience also includes managing a federally funded program at Lutheran Community Services Northwest that assisted immigrants in removal proceedings with navigating the complex immigration court system.

Rich serves on the Executive Committee of the Washington State Bar Association’s Corporate Counsel Section.

Representative Cases

• Employment Law: Counsels clients on various labor and employment law disputes, including enforcement of noncompete agreements, advancing and defending wrongful termination and discrimination-based claims, and resolving administrative proceedings initiated by former employees and customers.
• Construction Law: Obtained dismissal of all tort-based claims brought against construction materials producer in Superior Court, which was affirmed on appeal.
• Business and Corporate Law: Secured favorable high six-figure global settlement of tangible property tax appeals on behalf of family-owned towing and transportation company.
• Trust and Estate Litigation: Represented corporate fiduciary in successfully resigning and appointing a suitable successor trustee in contested Superior Court proceedings involving an eight-figure family trust share, resulting in court approval of all the trustee’s attorney fees.
• Trust and Estate Litigation: Represented corporate fiduciary in contested Superior Court proceeding to divide seven-figure trust into individual shares, with court approval of all the trustee’s attorney fees.
• Land Use and Real Estate Law: Obtained dismissal of breach of fiduciary duty claim brought against clients in connection with the transfer of real property under a durable power of attorney.
• Business and Corporate Law: Represented prominent supplier of heavy equipment and power systems in securing repossession of commercial property and obtaining a stipulated judgment on six-figure breach of contract claim brought in federal court.
• Pro Bono: Amicus curiae counsel in Washington Supreme Court case affirming that a respondent is not entitled to present a criminal affirmative defense against a petitioner seeking a civil sexual assault protective order.
