At the US Consulate in his native country. The husband does not adjust status. He has to be interviewed for immigrant visa in his country.

One of the requirement is not to save legal status on June 15, 2012. If you had legal status on June 15, 2012, you don't qualify.

I am so sorry for your loss. You should not file for AOS based on the approved I-130. You either need 1)humanitarian reinstatement or 2) new I-130...
