Infraction filled out with wrong info . Officers inability to properly enter correct info should be a winner for me. Dear Mr. Jones, I am sorry that you were dissatisfied with the outcome in your case. It was a 17 over the speed limit (42/25) in a City Court that has a prosecutor appear. That, plus your record and the fact that you have a CDL, make it difficult to risk fighting a case where the risk is that you would lose because the Court only needs to be convinced by 51% in traffic matters. The issues that you argue was "wrong info" and therefore the case should have been dismissed, was an alleged wrong date of your registration expiration, which has absolutely no bearing on whether you were speeding. Pursuant to IRLJ 3.1 (d) Sufficiency. No notice of infraction shall be deemed insufficient for failure to contain a definite statement of the essential facts constituting the specific infraction which the defendant is alleged to have committed, nor by reason of defects, imperfections, or omissions which do not tend to prejudice substantial rights of the defendant. This was not a winning argument. Pursuant to State v. Zhao, a plea agreement/amendment is acceptable for resolution of a case and the amended charge is not a lie. Even with all the above, I was able to secure you a potential dismissal of the charges with no fees, if you were willing to take a $28 driving course that can be completed in less than thirty minutes; however, you chose not to be willing to take the class for the dismissal, as you had done two years earlier. Even without you being willing to secure a dismissal, I was able to get the matter amended to a non-moving violation of failure to sign your registration and reduce the penalty from $207 down to $75 and no effect on your insurance. I did not get this amended to a no seatbelt, as many other attorneys would have as that would have effected your CDL. It is not about the money as you claim, it is about your record and keeping it clean over the principal of being right (that you weren't speeding) and it going on your record and having to pay increased insurance premiums for the next three years and risk your livelihood of driving.
