You can't get a old DUI expunged in any state I know of when you have new criminal charges pending.

With a cruz waiver, he could be sentenced up to the max. If he goes it to court ASAP, he'll likely just be remanded the same day.

Not likely but call the Texas DMV to find the status of your right to drive in Texas and what you'd need to do to get it reinstated.
