He should tender the suit to his insurance company. It will defend the case.

Accident occur where my son was a passenger. The owner of the car was not driver it was someone who was not on the policy.

I think the driver's insurance is primary. But agree that you really don't need to sort it out and the best practice is probably to submit claims...
