Client was arrested for DUII after driving wildly, almost into ditch. Taken into custody at gunpoint by three officers who all testified that he had a strong odor of alcohol. Client took the breath tes ... t after his arrest and blew a .17 BAC. Well over the legal limit of .08. I filed a motion to suppress the BAC result based on a violation of statutory and constitutional rights. The Court suppressed the BAC result and that evidence wasn't allowed to go to the jury. After a two day jury trial, the Jury returned a Not Guilty verdict in ten minutes. Client was the manager of security at an upscale mall. A conviction would have caused him to lose his job.
