Accused was convicted and sentenced to death for conspiracy to commit robbery and murder, conspiracy to commit kidnapping and murder, two specifications of violation of a general order, two specificati ... ons of premeditated murder, robbery, and two specifications of kidnapping. On appeal, the Navy-Marine Corps Court of Criminal Appeals set aside the death sentence and gave a sentence of life in prison.

Conviction for sexual assault under Article 120, Uniform Code of Military Justice, Reversed on appeal by the Court of Appeals for the Armed Forces. One of the more bizarre cases I have been involved i ... n. Article 32 hearing said there was not enough evidence to go to a court martial, but the command went ahead with it anyway! Then, there were so many errors in the trial that it was difficult to pick which was the worst. Client still in service and fighting for benefits and pay he should get but the government simply won't provide.

OUTCOME: Attempted Murder Conviction Reversed

Conviction reversed for attempted premeditated murder, solicitation of another to commit murder, and use of interstate commerce facilities in the commission of murder-for-hire in violation of Articles ... 80 and 134, Uniform Code of Military Justice. Client was caught in a sting operation where he was videotaped asking another service member to kill his wife. The other service members was working undercover for law enforcement. We argued that the client had not taken a "substantial step"--had not done enough to show he was willing to go through with the murder-for-hire plot. Court agreed.
