Lyons v Wickhorst, 42 Cal.3d 911 (1986)
N/AOUTCOME: Unanimous victory in California Supreme Court
I represented a lawyer who had his own case. He refused to participate in judicially mandated arbitration of that case. The trial court denied him a trial de novo. The Court of Appeal upheld the t ... rial court. I got the California Supreme Court to unanimously reverse both lower courts and to hold that while someone who does not participate in good faith in judicially required arbitration can be sanctioned, such a party still has a right to proceed to trial upon conclusion of the arbitration proceedings.
