Greg immediately persuaded the Court to set aside the TRO, returned his client to operating the business before the TRO was issued, counterclaimed against plaintiff for various causes of action and fought hard for his client and negotiated a Buy/Sell Agreement.

OUTCOME: Dismissal from the lawsuit.

Plaintiffs alleged claims for environmental contamination, intentional battery with allegedly radioactive oil well tubing, and other similarly specious claims. Instead of asserting their claims in an ... arbitration in Houston, Texas, as they had agreed in writing to do, plaintiff James A. McAllen, Jr. and his fellow plaintiffs filed suit in McAllen, Texas, the city named after Mr. McAllen's ancestors. Two weeks after the oral argument, the Texas Supreme Court issued an interim order granting our request for a stay of the entire case pending the Court's decision on the merits of the appeal. In August 2008, the Texas Supreme Court issued its opinion on the merits, reversed the court of appeals' judgment, and remanded to the trial court with instructions to compel arbitration – granting the complete relief we had requested. I eventually obtained a complete dismissal of our client, Conoco Phillips, from the lawsuit.
