PNK sued Mobilelink for breach of contract and the trial court awarded PNK more than $70,000 in damages plus attorney's fees. Mobilelink appealed, complaining that the evidence showed it was excused ... from performing due to PNK's alleged breaches of the contract and did not adequately prove its damages. PNK defended the appeal on the grounds that Mobilelink waived the contractual provisions about which it continued to complain and that it adequately proved its damages. The Houston 1st Court of Appeals affirmed the trial court verdict in its entirety.
