The application is filed with the United States Patent and Trademark Office at which time the application enters the "patent pending" phase. A usualy pendency time of two years is typical. During the two years, our firm prosecutes the application through to an issuance. Once issued, the patent offers twenty years of protection in the case of utility patent applications.

Ownership in a copyright is created once the author fixes the work (e.g. a book, artwork, computer program, sculpture) in a "tangible medium." (e.g. paper (book); flash drive (computer program); bronze (sculpture)). A copyright application is applied for in order to enforce an author's copyrights in federal court. Typical pendency is less than 8 months.

Patent infringement occurs when a third party produces a product which incorporates the elements of at least one claim of a patent owner's patent. The elements in the claim must be interepreted for their meaning and then matched against the infringing product. If a match is made, then infringement is likely. The patent owner can seek damages and an injunction as remedies for patent infringement.

A trademark is typically a word or group of words or a logo which identifies the source of a good or service. A federal trademark application can be filed to provide trademark coverage throughout the 50 states, provided that no confusingly similar marks exist. The time from filing to issuance in the case of federal trademarks is usually about a year.

Trademark infringement occurs when a third party uses a trademark owner's trademark in a confusingly similar way. Usually the third party and trademark owner operate in the same industry selling the same goods or services. An owner has the option of suing for common law, state trademark or federal trademark infringement. In the U.S. merely using a mark without ever registering it will grant the user ownership rights which the owner can then enforce in court.
