Plaintiff was a software developer and co-owner in the defendant company. The plaintiff had developed a proprietary bulletin board program which powered a major Honda enthusiast website, called Honda- ... Tech.com. An ownership dispute arose between the plaintiff and a prinicpal in the defendant company, Relynet, Inc., with the result being that the plaintiff was locked out of Relynet. The plaintiff remained owner of the Honda-Tech software copyright. Relynet ended up selling the Honda-Tech website for over three million dollars. Plaintiff, who was represented by Costello Law Corporation sued for copyright infringement and was awarded a total damage and attorney's fees award of 1.6 million dollars.
OUTCOME: Defendant withdrew its accusations against Plaintiff and paid a settlement.
Our firm represented the plaintiff (Eagle) in a declaratory relief action in federal district court in Sacramento. Sentech, a Florida corporation initially accused Eagle of infringing several patents r ... elated to a self-regulating air cushion having a module which regulated the amount of inflation of the cushion so as to minimize bed ulcers on hospital patients. After being threatened with a patent infringement lawsuit by Sentech, Eagle, on advice of its counsel from Costello Law Corporation, struck first by filing a declaratory relief action. Eagle sought a declaration from the federal court that 1) Eagle was not infringing Sentech's patents and 2) Sentech's patents were invalid. The case progressed up through the "Markman" stage whereupon, Sentech decided to settle with Eagle. Sentech agreed to withdraw its accusations of infringement against Eagle and also paid Eagle a cash settlement amount.
OUTCOME: Case settled with defendant ceasing and desisting from infringement of the travel guides.
The client had a very profitable travel guide that it had copyrighted. The client sold the travel guide throughout Elks Clubs in the United States and the guide had become so popular that it was a sig ... nificant source of charity income for the Carmichael Elks. The Carmichael Elks used the proceeds of the travel guides to fund a variety of charitable causes. The defendant was a rogue member who had helped the Elks publish the guide. After a falling out, the defendant took it upon himself to publish the guide on his own, thus committing copyright infringement and also severely curtailing the Elks' charity revenue generated by the guide.
