I am very excited to announce that I recently passed the California Legal Board Specialist examination for family law attorneys. Only a limited number of attorneys in the Central Valley area successfully pass this exam. This is a great honor and a testament to the vast knowledge and experience of family law statutes and case law possessed by the attorney who becomes Board certified. Unfortunately, we family law attorneys do not have control over the court docket and cannot force the Court to move quicker or set trials sooner. This process simply takes patience. There are a few tips I can provide regarding child support arrears that will help with collection efforts. Although there is no statute of limitations for collecting past due child support arrears, you should not wait to start enforcement efforts. The longer you wait, the more difficult the collection efforts, especially if you wait in excess of 15 years. Remember also there are often defenses for failure to pay child support when due. For example, if a minor child changes residence to the obligor parent, that change may give the obligor an opportunity to raise an equitable relief defense. It makes sense if you think about it. There are many tips I can provide for a successful attorney/client relationship. For example, it is very important to disclose all pertinent information to your attorney. Waiting until the last minute will not benefit anyone. We care for our clients and strongly advocate even when we are presented with difficult and challenging issues. In fact, there are times that we have waived fees even though we advocated strenuously and presented all that there was to offer. We do this because we care and because the facts do not always support the clients desired results! There is one last tidbit of advice. You can go to the California Bar website when searching for an attorney rather than believing what you read or hear about an attorney. The Bar will post disciplinary action taken against an attorney. Research the truth and make an informed decision about your legal representation. Do no hesitate to call for your free family law consultation and decide for yourself.
