DON'T FIGHT YOUR LANDLORD WITHOUT A COMPETENT ATTORNEY...

My story: I have rented an apt. in Modesto for five years as a responsible tenant. The apt. is in foreclosure. In August I received a 3-Day Notice to pay rent or move out. I ignored because I was told that since the owner was in default on the mortgage the bank was entitled to the rent. I figured t...hat I would withhold rent and pay the bank when they came knocking. Next thing I know I was served a, "Summons and Complaint- Unlawful Detainer". How clever of them to serve this at 10PM which uses up the first day. You have just 5 days to answer or a judgment will be entered in favor of the landlord. Your credit will be ruined, And it will be difficult to rent because your name will be on a blacklist. Forget about buying a house for the next 5 years or more, Now my situation is I'm a disabled vet with a service dog and no car. I went to the following tenant resources for help: CRLA(Calif. Rural Legal Assistance), Senior Law Project, Project Sentinel, Self-Help(2nd fl. in Court House) and at least a half-dozen law firms. Only CRLA helped in that they offered a work shop on how to answer the complaint, "In Pro Per" meaning you become your own legal counsel. I desperately wanted to save my credit. And decided to hire an attorney who handled eviction defense and Landlord/Tenant law. Until I met with Kenneth Hedberg, Esq. I couldn't sleep. I can't believe it but he was able to talk with the Landlord's attorney and get it dismissed the very next day. Believe me to go this alone and face an attorney for the plaintiff in Superior Court on your own would be too risky when you consider what's at stake. My heartfelt thanks to Ken Hedberg. I learned my lesson. My landlord has converted me to a homeowner... If you find yourself in a like situation ask Ken to relate my story. All the best , Joe
