My Philosophy for Resolving Your Family Law Problems:
If you are reviewing this you may fall into one of the following categories:
• You are contemplating leaving your marriage. You have your reasons (which may be valid) and your spouse does not know about this development.
• You are in shock because you have been served with divorce papers or have just been told by your spouse that he or she wants a divorce.
• You and your spouse have agreed on at least one thing lately, you have both accepted the death of your marriage and you both want to proceed with economy dignity to fair resolution.
• You are contemplating marriage (or you are already married) and want to define the property rights and support obligations between you and your spouse.
• You are already divorced and due to a change in circumstances, you need to modify your court orders with respect to support or custody.
• You are the parent of a child. You and the other parent are not married, but you want to formalize the parent/child relationship and provide for the support of that child.
• You are in a domestic relationship that endangers you and/or your children. You need an order of protection from the court to help stop the violence.
In each of these scenarios, you need legal advice. You don't need drama. You don't need revenge. You don't need vindication as the "innocent spouse." My Approach to Firearm Cases:
Because cases involving firearms are fraught with the risk of criminal sanctions, we can only offer the following overview and temporary advice pending a confidential consultation:
• Do Not talk to law enforcement officials (uniformed police, detectives, technicians, CHP, Distrist Attorney Investigators, etc...) without having an attorney present. This is a right guaranteed by the 5th and 6th Amendments to our Consitution. Invoking this right is not evidence of anything and insisting on these rights cannot be used against you in any legal proceedings.
• Do Not consent to any search of any kind, including, but not limited to your house, storage sheds, garage, vehicle, person or campsite. This is a right guaranteed by the 4th Amendment to our Constitution. If the Police have a warrant do not intefere in the execution of that warrant.
• Do Not post pictures or descriptions of your firearms, ammuntion, magazines, accessories or parts on any social media websites or send digial pictures to anyone you do not absolutely trust.
• Do Not discuss your legal issues (of any kind) on social media or over any unsecure communication network.
Law enforcement personnel have a job to do. That job is to build a case to convince a judge to issue a warrant, a convince a grand jury to issue an indictment, or convince a jury of your peers to send you to prison. You should always assume that you are the target of that warrant, indictment or criminal charge.
A criminal defense attorney has a tough enough job defending you from the full might and power of the government without having his/her client provide testimony and critical evidence to the government could they would not be able to develop on their own.
Consider this: If that same police officer trying to sweet talk you into waiving these rights was a suspect, he would invoke in heartbeat, and then call is lawyer. You should do the same.
They aren't rights if you don't exercise them.
