Do not hire Eric R. Wagner. He accepted a $15,000 settlement from GEICO on March 13, 2023, without my consent — I had explicitly rejected a lower offer on March 8, 2023. GEICO records confirm he called to accept before sending me any release form (which only arrived March 14). GEICO does not require... the client's signature for the check to be issued if the lawyer accepts. I requested the settlement release form be mailed to my residence so I could review it and ask questions. He said he would mail it, but I never received it. He also said he would email it, but that didn't happen until after he accepted the offer. I do not have a computer or laptop — only a cellphone — which made it difficult to download and view emailed files properly (some downloads were cut off or incomplete). This is why I request Eric to mail important documents to me. Like my retainer agreement and the Wagner law firm guidelines he mail to my resident. He withheld multiple GEICO emails from me until after I fired him on September 2, 2023. When I received my file, I discovered correspondence I had never seen. My AT&T records show calls and voicemails in March 2023 that were missing from his file — including several voicemails I left reminding him I did not agree to any GEICO settlement after March 8, 2023. His file only included 2 voicemails from late February and one from mid-April. The State Bar dismissed my complaint, relying on his claim that he "promptly notified" me, but the timeline and documents contradict this. I am still in constant pain more than 3 years later, with a neurosurgery recommendation for possible spinal surgery due to the accident's effects.
