Refused to respond to correspondence after taking my case

For 5 months after her and her partner David Ratner took my case, I emailed or called about once a week or two. I left voicemails, called multiple phone numbers, her personal cell, her partner David's personal cell, left messages with their receptionists, emailed them both. Then David started commu...nicating with me, but it did not go well, because he consistently misunderstood the facts, and was quick to make false accusations against me. I kept calling and emailing her, trying to de-escalate the situation, and about 7 months into being so-called "represented", she finally answered the phone. At first she treated me really badly, but in less than 2 minutes into the conversation, she realized that I am a normal rational person, and we had about a 30 minute conversation where she heard out my concerns and promised to look into what she could do. Unfortunately, her partner made it clear that he was not going to fulfill his basic responsibilities as an attorney and was a bad lawyer. I requested records from her and her partner, and she has ignored me. I am entitled to the records under law. She was meant to represent me at the trial. Refusing to communicate with someone is not a good way to do a good job at a trial. It was an extremely serious case. And I consider myself deliberately sabotaged by their firm.

This was a a pro se litigant that the Judge referred to the Federal Pro Bono Project ("Project") for representation. The scope of the referral to the Project was to take the case to trial based on the current record. By the time the Judge referred the reviewer to the Project, the case had been pending for 17 months, trial was in 6 months, and fact discovery and expert discovery was closed. Ultimately, there was a breakdown in communication over what the law allows, the Orders that already existed in the case, and the boundaries we were willing, or not willing, to push. From the time the Judge appointed my firm as trial counsel until the reviewer filed a motion to relieve us as counsel, was exactly 3 months. It is impossible, based on the public record of the case, for us not to have responded for months at a time. I understand the reviewer was frustrated with how the law works, as I experience that frustration often as an attorney, but unfortunately those are the rules within which one must operate when seeking redress in a court of law.
