Rod Michael Fliegel

Rod learned about the practice of law from his father and considers himself "old school" in terms of his work ethic, responsiveness and devotion to his clients. He bonds with his clients by learning about their priorities, devising strategy and achieving results. He has worked with many of his clients for a decade or more.

Rod Co-Chairs Littler's Hiring and Background Checks Practice Group. Rod has broad experience in employment law and significant expertise in class action defense, including defending nationwide FCRA claims against employers and background check companies (CRAs). Rod also has extensive experience defending employers in state, federal and administrative litigation, including matters with the EEOC, FTC, and NY AG. As the national coordinating counsel for several clients, Rod oversees matters throughout the country.

Select examples of Rod’s litigation experience include the following:

-Prevailed on a Rule 12 motion in a nationwide FCRA class action against a CRA.

-Defeated a class action invasion of privacy claim brought by Teamsters workers.

-Defeated with a dispositive motion the bellwether case in a 1,450 mass action for California FCRA violations.

-Successfully defended numerous employers in background check related investigations by the FTC, EEOC and like agencies.

-Secured a seven-figure pre-trial settlement in a trade secret dispute (representing the plaintiff).

-Prevailed on a Rule 12 motion in a California FCRA class action against a CRA.
