11/4/09: Today I appeared for a client at the Concord courthouse of the Contra Costa Superior Court. Client charged with driving on a suspended license misdemeanor. This was a former DUI client and ... he really couldn't take any additional points on his driving record. Case dismissed. Lack of evidence.
OUTCOME: Probation, 120 days HOME DETENTION, NO JAIL
Oakland is the best place in the Bay Area to get a third offense DUI. Third Offense's are often difficult cases because the client, who has rarely been to jail for any significant time, is looking at ... a mandatory minimum of 120 days jail, but most counties bump it up to six or eight months. This is ACTUAL CUSTODY. Settled a third offense DUI in Oakland quite efficiently for probation, fines, 18 months DUI school and 118 days of home detention. Client received no actual jail. License was revoked by DMV for three years but client should be eligible for restricted license after completing 12 months of DUI school. This case was really a joke and an example of how varied punishments can be. For example, same case in Pleasanton, which is still Alameda County, would probably result in 160 days actual custody in Santa Rita Jail, which was recently profiled on television as one of the toughest jails in the USA. Oakland is such a breeze, this particular client even got arrested for public intoxication while on home detention and didn't get any additional punishment. Better people have done more time on less serious third offenses' than this client. Gee whiz, the court even let him leave home for work, church, AA meetings, work trips, to go to the gym and even visit his kids. I have a feeling this client may not have learned his lesson and may be back for number four, which would be a felony. License was revoked by DMV for three years but client should be eligible for restricted license after completing 12 months of DUI school.
OUTCOME: Reduced to "Wet" Reckless, DMV "Set Aside"
10/30/09: After winning the DMV hearing and getting a set aside of client's license suspension, I settled his criminal case today for a wet reckless. The DUI and Refusal allegation were dismissed. T ... his case was heard in the Oakland courthouse of Alameda County. Client's case resulted in 2 years of probation, fine and DUI school. No jail or community service and NO LICENSE SUSPENSION.
OUTCOME: DUI Dismissed, Case Reduced to "Wet" Reckless
7/10/09: Settled a .11, .11% BAC DUI case in the South San Francisco branch of San Mateo for reckless driving. Client recieved: Two years of informal probation; find of $1,301 and had to complete a ... level one DUI school. Received suspension credit from DMV and client only served one week of actual suspension.
OUTCOME: Enchancement Stricken & DMV SET ASIDE
10/23/09: .18% SF DUI, DMV SET ASIDE. San Francisco case with high BAC enchancement. DA demanded 9 month DUI school, so I filed a Motion to Suppress Evidence. Case settled at motion for three years ... of probation, fine of $1,650, THREE MONTH DUI SCHOOL, and one day of SWAP. Received a "set aside" at subsequent DMV Hearing.
OUTCOME: Enhancement Dismissed, Probation, Fine, DUI School
10/19/09: Client charged with DUI and seperate misdemeanor exhibition of speed charge (Vehicle Code section 23109). Successfully got the exhibition of speed charge dismissed and client pled to DUI on ... a .14% BAC case for: three years probation, 3 month DUI school, fine of $1,760 and seven days of community service.
OUTCOME: Petition Granted, DUI Conviction Expunged
10/15/09: Today I got an order expunging a woman's 1998 DUI conviction in San Francisco. This was the final step to getting this case dismissed.

10/15/09: Settled a first offense DUI in San Francisco this morning. Client had .22% BAC by way of blood test, blacked out and totalled her car by smashing into three parked vehicles. Client recei ... ved: 3 years informal probation, fine of $1,652, 5 days of community service/SWAP, and a 3 month DUI school.
OUTCOME: ENHANCEMENT STRICKEN. 3 MONTH SCHOOL
10/15/09: As associate with the Law Office of Robert Tayac, I settled this first offense DUI case for a professional client working for Apple. Case involved high BAC blood test over a .20% and a thre ... e car collision. Client suffered minor injuries and was taken to the hospital. Successfully settled the case for excellent result: three years informal court probation, fines and fees, THREE MONTH LEVEL ONE DUI SCHOOL (9 month is the standard), and 5 days community services served through SWAP. Client's car was totaled by collision. License suspended for 30 days and restricted for 5 months. Client ordered to pay restitution for all damages.
