OUTCOME: CASE DISMISSED
Although I really don't handle minor traffic infraction cases, this one was an exception and one I volunteered to handle "Pro Bono." Client and three sisters were stopped by a Berkeley Police Departme ... nt officer who shamelessly cited them for an illegal left turn as they were turning into their church for Sunday services. Perhaps we had the Lord's blessing as I appeared today in Oakland and the case was dismissed!
OUTCOME: DUI CHARGES DISMISSED: CASE REDUCED TO RECKLESS DRIVING
Client stopped by San Bruno Police Department for speeding. No PAS test, but police find both drugs and alcohol in the car. Client submits to BREATH test of .08 % and .09 % respectively. Case settle ... d today for dismissal of DUI charges in exchange for plea to Reckless Driving. Client sentenced to 2 years of informal probation, fines of about $1,500 and a 12 hour DUI School. No jail or SWAP and we live to fight another day at the DMV.
OUTCOME: Probation Granted: 3 years probation, fine $1,900, 3 Month DUI School, One DAY SWAP
Client driving and stopped by CHP for speeding. No PAS test, but BLOOD came back .14% BAC. Settled case today for dismissal of 12500 CVC misdemeanor. Three years probation, fines of approximately $1 ... ,900, three month DUI school and one day of SWAP in lieu of jail.
OUTCOME: Refusal DISMISSED & DEFEATED AT DMV
Excellent result since we were able to beat the refusal at both DMV and the criminal court thus avoiding a harsh two year license suspension. Client admitted high BAC enhancement instead for 4 years c ... ourt probation, fine of about $1,900, 18 month DUI School and 18 days of SWAP in lieu of jail. Client eligible for restricted license after 90 days suspension with installation of Ignition Interlock Device "IID".
OUTCOME: DUI CHARGES DISMISSED & CASE REDUCED TO RECKLESS DRIVING
Client stopped by CHP for speeding, 85 MPH and weaving. PAS test comes in at .11% and .11% BAC, respectively. Client submits to BREATH test at station with two results of .10% and .10% BAC. DA charg ... ed client with Reckless Driving Speed Enhancement, which is really the worst since it carries a mandatory 60 day jail sentence. Settled case today for dismissal of DUI and enhancement for plea to reduced charge of Reckless Driving. Three years probation, reduced fine of $925, NO JAIL or SWAP. license suspension for 30 days with five month work restriction.
OUTCOME: DUI CHARGES DISMISSED & CASE REDUCED TO RECKLESS DRIVING
Client crashed car near SF state. Minor injuries but client's blood came in .11% BAC and he was under 21. Complicating matters, client allegedly resisted arrest and assaulted one of the arresting off ... icers of the San Francisco Police Department. Today, we settled the case for dismissal of the DUI, Assault and Resisting charges. An excellent result since client received three years probation, three month DUI school and NO SWAP or Jail and 40 hours volunteer work.
OUTCOME: One Year Diversion, $250 Fine & BOTH Cases to be DISMISSED
Client arrested for two different incidents of Public Intoxication (Penal Code Section 647(f)) by Novato Police Department. With my encouragement, client went to residential treatment for over seven m ... onths and we were able to use that to negotiate a "stay out of trouble" diversion for client for one year. All client has to do is avoid any arrests for one year and both cases will be fully dismissed.
OUTCOME: CASE DISMISSED FOR LACK OF EVIDENCE
OUTCOME: PROBATION GRANTED; NO LICENSE SUSPENSION
Client had .12% BAC DUI hit and run collision case in Hayward which I resolved earlier in the year for a reduction to "reckless driving" and subsequently avoiding the mandatory IID. Client picked up a ... speeding ticket thereafter, giving him a total of four points and opening him up to a potential 6 month DMV license suspension. Today, we appeared together and after considering the client's testimony and the oral argument I made on his behalf, the hearing officer agreed to place the client on DMV probation (no points for one year) instead of suspending his license. In other words, the best possible result for the client as we saved his license and livelihood.
