Client had two prior DUI convictions and multiple prior convictions for driving on suspended license. Client arrested for DUI by Hercules Police Department after totaling a car in a collision. Client ... was on DUI probation and did not have a valid license. Blood test came back .10% BAC. After months and months and multiple court appearances, I successfully resolved this case today for a NO ACTUAL JAIL resolution. Client sentenced to 5 years probation, fine of $1,900, 18 month DUI School and 180 days of residential treatment.

Client stopped by the California Highway Patrol for weaving and speeding. DUI investigation followed with PAS tests of .09% and .08% BAC. Client arrested for DUI and submitted to breath test with res ... ults of .09% and .09% BAC. Today we settled case for dismissal of DUI charges in exchange for plea to reckless driving. Client received two years of probation, fine of $1,000 and 12 hour DUI school. Client found "not guilty" of driving with BAC in excess of .08% so NO DMV SUSPENSION.

Client rear ended vehicle at stop sign. Napa Police Department investigated DUI and client submitted to PAS test with .13% BAC and later a blood test of .13% BAC. Since client was just visiting Napa ... from out of state, it was key that we settled the case for outcome that never required her to travel back to California. Today, I did just that and she was sentenced to three years probation, fines of about $2,500, 3 month DUI school (online OK) with 16 hours of volunteer work at non-profit in lieu of the mandatory jail or SWAP time.

OUTCOME: DUI Charges DISMISSED. Case Resolved for Reckless Driving

Client was stopped near Eden Canyon Road by the Dublin CHP for a welfare check since his vehicle was near the side of the road illegally parked. Officer made him submit to a PAS breath test with resul ... ts of .11% and .11% BAC. Client was arrested for DUI and then opted for a blood test which came back .14% BAC. Client was in a bind since he couldn't take a DUI conviction which in Alameda County would have resulted in a mandatory ignition interlock device ("IID"). Gratefully, I was able to convince the DA to dismiss the DUI today in exchange for a plea to the lesser charge of reckless driving. Client sentenced to three years of court probation with a fine of $925, a three month DUI school and 50 hours of community service. A great result since without the DUI, client will not have to endure the stigma of the IID.

Client was stopped by the Castro Valley CHP for weaving and erratic speed. He submitted to two PAS breath tests of .23% and .21% BAC and was arrested for DUI. At the station, client again submitted t ... o two breath tests with results of .20% and .19% BAC. Client was released when sober, but subsequently moved out of state before the criminal case could be resolved Today, I appeared on client's behalf and resolved the criminal case for a dismissal of the high BAC enhancement for minimum punishment of three years informal court probation, fine of $1,963 and three month DUI school which he will only need to complete if he moves back to California. Additionally, client required to complete 40 hours of community service in lieu of jail and his license was suspended for six months since he no longer lived here and thus could not get a "restricted' license

Although I really don't handle minor traffic infraction cases, this one was an exception and one I volunteered to handle "Pro Bono." Client and three sisters were stopped by a Berkeley Police Departme ... nt officer who shamelessly cited them for an illegal left turn as they were turning into their church for Sunday services. Perhaps we had the Lord's blessing as I appeared today in Oakland and the case was dismissed!
