Driver was in a rollover accident and airlifted to a hospital in another county. CHP obtained one breath test, showing an alcohol level of 0.14. CHP alleged he refused further testing. Because he ha ... d a prior DUI conviction, he faced a two-year license revocation, the 18-month alcohol education class, and jail time or supervised home confinement. We won his DMV hearing and, after a year-long battle at court, got his charges, we got his charges reduced to a "wet reckless."
