Driver charged with DUI. He took three breath tests, all with results of 0.17, more than twice the legal limit. A trial resulted in a hung jury. Rather than try the case again, the prosecutor agreed... to a plea to a "wet reckless," a reduced charge. We won the DMV hearing. So the driver avoided a license suspension, jail time, and the alcohol education class.

Our client was in a serious accident in which vehicle went off the road and into a ravine. An ambulance took him to the hospital. The police obtained a search warrant to take his blood while he was l...ying on a gurney with a neck brace. His blood test showed an alcohol level of 0.24% - three times the legal limit. We filed a motion to suppress evidence, alleging that his constitutional rights were violated. After a two hour hearing, the judge agreed. The case was dismissed!

Halfway through the hearing on our motion, the District Attorney moved to dismiss the charges.

He was charged with a DUI and face a license suspension, fines, a 30 hour alcohol education class, and several days jail time, which he would complete in the Sheriff's work alternative program. We won his DMV hearing and he pled to a "wet reckless" (a reduced charge) at court.
