If a Living Trust owns your property when you die, then you may avoid the high costs and hassle of probate, conservatorship, and estate taxes. Also, Living Trusts are private documents, protecting your information from identity theft and predators. The Living Trust is a must for those who own real property in California.

Wills and Living Wills 20%

For those who own property below $150,000 and / or don't own real property, you may only need a will to express your wishes if you die. A Pour-Over Will is a will that makes your Living Trust the beneficiary. I include a pour-over will with all living trusts I create. A Living Will informs your Doctor that you don't want to be kept alive artificially if there is no hope of recovery. In California, the controlling health care document is the Advance Health Care Directive, not the Living Will.
