Erik E. In that capacity, he has provided guidance on a variety of legal matters, including but not limited to, litigation, compliance, regulatory, intellectual property, real estate, risk management, corporate governance, and dispute resolution issues.
Some of his representative cases include:
Successfully resolved a $50MM lawsuit involving a non-performing loan secured by a residential development and negotiated favorable terms used by the client to sell the note to a third party. As a General Counsel, played an integral role in supporting a small, 2-person fitness company in Orange County expand into a national business with more than 1,500 instructors across the country; managed all aspects of corporate structure, contracts, marketing issues, and business development. Directly worked with a large bank client to favorably resolve more than $150MM in non-performing assets through litigation and alternative restructuring. Defense victory for multi-national client through jury trial and subsequent appeal in a $40,000, contractual dispute involving a multi-level commercial transaction. Significant win for national grocery chain in a premises liability dispute where defendant had conceded liability. Jury awarded damages of $150, -- client had offered $350, in mediation and Plaintiff sought more than $1,500,. Defended and successfully resolved a multi-million dollar negligence case against a national restaurant chain surrounding the wrongful death of one of its employees, where the alleged acts of the defendant led to a change in legislation concerning liability in the state in which the case was filed. Settled contentious fraud and misrepresentation matter involving the purchase of a commercial entity, resulting in a net benefit to the client of approximately $500, more than would have been available through trial. Participated in the successful defense and litig ation of a $50,000, lawsuit involving multiple real estate and commercial entities in a complex dispute over asset allocation and entitlement. Successfully participated in the defense of numerous product liability claims made against an international medical device manufacturer in a multi-million dollar class action suit. Served on legal teams acting as national trial counsel for various product manufacturers and medical care facilities.
Mr. Woodbury is admitted to practice in California, Florida, Georgia, and the U.S. Virgin Islands, and is active in the legal community as a member of the California and Orange County Bar Associations; Florida Bar Association; Virgin Islands Bar Association; Georgia Bar Association; American Bar Association; Association of Trial Lawyers of America; and the Litigation Section of the ABA.
While at Boston College, Mr. Woodbury was a member of the varsity soccer (1990 - 1992) and football teams (1992 - 1994), and was a finalist for the Chevrolet Scholar Athlete Award.
