People v. Michael Baker (Residential Burglary)

Brian Gurwitz and I defended Mr. Baker who was charged with a felony strike residential burglary of an occupied dwelling. Toward the end of trial we discovered through cross examination of a Deputy Sh ... eriff that a video tape existed that had not previously been turned over by the prosecution in discovery. This video clearly showed that two police officers had given false and misleading testimony at trial and when the prosecutor reviewed the newly discovered evidence, he concurred and immediately dismissed all charges against our client.
