I engaged Randy curry in Dec of 2020 to help represent my son in what he and I both agreed was unethical behavior by Blue Shield of CA regarding their denial of services for my autistic son. Randy told me that I needed to get a personal insurance plan for my son to avoid the ERISA statue. However Ra...ndy didn’t care that the insurance cost $500 a month and his request that I go out and get that insurance long before I could use it (he asked me to go get it in Dec 2020, however he knew I could not use it until May 2021) forcing me to waste $2500.
Randy then suggested I start by filing an IMR saying that it would cost me $4500 (paid directly to him) to have him complete the application and organize the letters of support from my sons health care providers. He also asked me to get these letters from all of my sons providers and one of the letters cost me an additional $3000 to have this HCP come and observe my son in our home.
Randy expressed on many a conversation how he was extremely confident that he would be successful because he had almost never lost these types of cases, and that Blue Shield would in-turn be forced to pay the additional services for my son. Then he said even if he was unsuccessful and we lost the IMR and we had to sue Blue Shield he was again extremely confident that we would win provided I had retained a personal insurance plan for my son to side step ERISA. Again with extreme confidence because in his words “He beats up on Blue Shield all the time” in these types of cases.
We lost the IMR decision, however Randy assured me that when my ABA provider replied for my sons services that if Blue Shield again denied their request we would move to a lawsuit.
However a month later when I gave my ABA provider my sons new insurance card and they requested services and were denied, Randy recommended I file another IMR (not sue) and pay him and additional $4500 otherwise we would lose the lawsuit. I asked why we hadn’t we discussed this from the beginning, because if winning the IMR was contingent on us winning a lawsuit why would I ever sue (or spend the money for an induvial insurance plan for my child, because if I won the IMR why would I have to sue? This is when I became upset and extremely suspicious.
After stating to Randy that this is not at all what we spoke about or agreed to throughout the process. Randy became defensive and condescending, telling me I must not have understood the process as he explained it. I asked Randy why I had retained the additional insurance and why weren’t we moving directly to a lawsuit. He never gave me an answer. I also asked him if he would consider doing the IMR on contingency he “NO”.
Randy’s poor legal advice and unethical behavior has cost me and my family close to $15,000 in Legal fees, HCP assessments and insurance. He is a parasite that prays on the hopes and fears of parents of children with special needs.
