Client was introduced to a friend of a friend and later that night, they had a consensual sexual encounter. After the encounter, however, the complaining witness told the police that she never consent ... ed and the Client took advantage of her while she was drunk. Irvine Police Department arrested Client at his business and Client immediately called Fred Thiagarajah. Fred Thiagarajah’s office immediately investigated the matter and discovered that the complaining witness went to a business conference with the Client and his friend the day after the initial incident and several witnesses could corroborate that the complaining witness appeared friendly towards the Client. After extensive communications with the DA’s office, the DA’s office declined to file charges in this case.

Facts – Client accused of violating Penal Code section 273.5 by punching his wife. Client is a permanent resident and a domestic violence conviction would result in deportation. Original offer from D ... A was for client to plead guilty to the charge and serve 45 days jail. After further negotiations, DA was willing to offer a reduced domestic violence charge (Penal Code section 243(e)(1)) but still required 45 days jail. We set the case for trial. After case was set for trial, we finally negotiated an immigration safe result of simple battery with 30 days community service.
