In April 2015 we had client's come in who thought the attorney they met at church in 1998 had put a special needs provision in their trust. They're only beneficiary was their son with down syndrome. Th ... ey came in and said they could not find the special needs provision in their existing trust. After review I told them the good news was they were not crazy but the bad news was no special needs provision so they were sitting on a ticking time bomb that may have devastated their son by getting him disqualified for government benefits and programs he was on had they died. We restated the trust ensuring they had the right provisions in it to keep their son safe from disqualification as well as personalizing their estate blue print that is reviewed again and again over the coming years.
