OUTCOME: Negotiated for Client to plead to only one charge as a misdemeanor--D.A. dismissed remaining felonies, reduced remaining charge to misdemeanor. Client's terms of probation was unsupervised probation, court fees, caltrans--no jail.

Client forged a driver's license, using his photograph and personal information, but assumed the identity of another person without their permission. He used this i.d. to obtain a credit line with Nor ... dstrom. Once he obtained that, he purchased a gift card. Before he could purchase anything, Nordstrom had contacted the actual person and determined Client had falsified the card. Client admitted to falsifying/forging the card to obtain the line of credit; was going to give card back to "mastermind" of this scheme and was going to obtain a commission from the transaction. Client admitted was going to conduct several more transactions in the future.

Client falsified time sheets and submitted to temp agency employer, allowing her to obtain over $4000 of unearned money. Company she worked for and temp agency who placed her there discovered the fals ... ification and confronted her. Client denied any intentional wrongdoing and resigned. D.A wanted 60 days jail, 3 years probation.

Client had blood alcohol level of .14, got into serious hit and run accident. D.A. initially wanted 90 days jail because of severity of hit and run.

Convinced city attorney to drop assault/battery due to Client's mental illness. Only terms were informal probation, and stay away from that neighbor.

Client is doctor charged with petty theft--caught on surveillance camera. Client previously had another petty theft case that was negotiated for dismissal. D.A. initially refused to allow diversion o ... r dismissal of any sort, only agreed to reduction to disturbance of the peace as a misdemeanor with terms. I finally convinced another D.A. to continue the case for 3 months so client could complete community service and make a donation to a victim fund. The key was to show that client's medical license was in jeopardy, and that she could be suspended or disciplined, causing severe repercussions as a mother going through depression and divorce. Case was then dismissed outright with no pleas.

SECOND DEGREE ROBBERY

OUTCOME: Assault with GBI, enhancements, and possession of stolen property dismissed; admitted robbery and received 7 months in juvenile hall.

Client was minor who was charged with assault with great bodily injury, second degree robbery, possession of stolen property, and great bodily injury enhancements--all felonies. Facts were that client ... along with 3 other defendants attacked a minor causing brain bleeding when they stomped on his head and punched him to unconsciousness. They did this because they believed he had taken their friend's bike. Client stored bike at his home. D.A. gave immunity to witness who was present with all defendants during incident--he was going to testify to client's involvement. Another witness id'd client's involvement. Key to negotiations was explaining how client had just discovered he was adopted and during this time, manifested his anger and depression by engaging in this type of behavior. Also emphasized client was not the mastermind, but was forced into participating by older defendants. Negotiated for earlier release by showing proof of tutoring program parents were enrolling client in, as well as other mitigating circumstances. Initial offer was 15 months juvenile hall, plead to robbery and assault with great bodily injury.

First time DUI with no defense--client pulled over for swerving and had defecated in pants. Terrible FST's and blood results were .12. Found out months after case went to court that arresting officer ... had resigned and was facing federal indictments for money laundering! I filed a motion to suppress, knowing that officer could not testify and would not appear. On day of motion, D.A. announced unable to proceed and dismissed the case.
