Bad Attorney for Trademark Litigation
I hired Mr. Cionca on a trademark litigation matter and although he is a nice attorney it is my opinion that he did a poor job on my case. He was not aggressive enough in my litigation case and failed to properly obtain necessary evidence during discovery that would have helped me prove my case at t...
This is inaccurate, and thus, unfair. First, it implies that I represented the client to the end of the case and he lost. Not true. Secondly, it suggests that I was allowed to complete the discovery. Not true. Third, it implies that a trial had taken place and he lost when in fact court's record appear to show that the parties were recently involved in several rounds of unsuccessful settlement negotiations and the case continues. The reality is that the client chose to hire a different lawyer, I guess now, a more "aggressive" one, in the middle of the discovery. I assume the "aggressive" way with the other lawyer does not work very well , and the client is upset. I understand. However, the assigning of the blame is misplaced in my view. My steady winning approach is based on good facts, good law and good arguments. The judge agreed with me on many occasions and the case was going well before client decided to switch in the middle of the case. I still wish that things turn around and the client wins in the end. I know he is a small business owner and he needs a win. I wish I had the chance to contribute to it.
