Justice is unattainable when the attorneys violate rules without consequences.

He was selected by a Plaintiff/attorney for arbitration on a fee dispute against me. The attorney NEVER SERVED ME NOTICE of the case. Six months later JAMS mailed notice of Preliminary Hearing, in four days, including a weekend. I requested the case manager to inform the court I was not served notice... and request a postponement to allow time to obtain the case info and representation. The hearing was conducted despite these facts. I have five USPS RTS with NOT DELIVERED marked and the date it was returned to sender for every mailing the attorney sent and was returned. Kirk never asked for "proof of service" to the attorney. In the Interim award Kirk stated I "refused to attend and would not participate in the arbitration." I could not find representation due to the limited time of four days between the final Hearing date and when the case information with Declarations, witness statements were entered into the file. Despite weeks past the deadline all were accepted. The full award was more than twice the amount sought after Kirk added fees, interests, costs, etc. I was denied the right to reject Kirk which I would have over his five checks in all of the Ethics rules on the Disclosure. I was denied my request for a Trial de Novo, citing the non-binding arbitration offered in the agreement. This was a team effort with the attorney. Note: the attorney filed in the Superior Court case for confirmation of award and NEVER SERVED ME and six months later I received notice of the hearing nine days from receipt of his mail. They were all approved. I give up on California justice, it is all about teaming up, I guess.
