Douglas Robert McClintock

I hired this attorney to prepare a QDRO for MY 401K and Cash Pension division. My X owes me child support arrears, child health care reimbursement costs, 401k loan reimbursement and credits for his small retirement he cashed in after the separation. I asked McClintock to include these deductions in... the QDRO and paid extra for this task. A week later he emailed the X and me and requested we sign the cash pension QDRO. I noticed the offset costs or deductions were not included. I emailed McClintock and said I had questions and would call him shortly. He said to email him my questions. When I asked him why he did not include the deductions he said they could not be included in the QDRO. I called three QDRO attorneys including my plan administrator and one family law attorney. They all disagreed and said it could be done with a cash pension. McClintock also said he sent in the cash pension draft QDRO for pre-approval but my plan administrator said they did not receive it. When I called the plan administrator again they said they did receive it but it listed my X as the participant and not me. In addition the plan administrator received it on May 21, 2015. I fired him on May 13, 2015. Since he appeared to be clearly incompetent and not representing my best interests I fired him. I was being generous and requested a 75% refund and he refused. He kept stating he completed one of the two QDRO’s so only approximately 50% was due for QDRO preparation. FYI - A QDRO is not completed until both parties sign it and the court approves it. He had the wrong participant named and I could have lost tens of thousands in deductions!!!!!!!!!!!! I’ve filled a small claims case and submitted a complaint with the California Bar Association.

Douglas McClintock handled my QDRO in a very efficient manner. My actual divorce was handled by another attorney who never even mentioned the need for a QDRO. Just after filing my divorce with the court, I learned that I needed a QDRO in order to apportion my 401k and that my original attorney di...d not handle QDROs . I wishI had hired Douglas McClintock to handle the entire divorce as he was very professional and mindful of the cost to me.
