Plaintiff was 32 y/o forklift operator, injured when forklift spun out of control in a refrigerated storage areas, and suffered a crushed left foot. Ultimately, Plaintiff had a below-knee amputation. ... Workers Compensation covered entire claim and all future care and retraining. I determined there was a potential claim against the refrigeration maintenance company for negligent care of its machinery, as condensation on the floor of the storage area may have contributed to the forklift spinning out of control. Despite full compensation under Worker's Comp statutes, we were able to obtain an additional settlement in the six-figure range for this man, over and above all other medical care and compensation he was entitled to receive under the Work Comp. laws.

This case was about the proper time to file a required notice of intent to sue a doctor or healthcare provider. A prior attorney had been consulted and served the notice of claim prematurely. I had n...o knowledge of this filing, and when I filed a second notice of claim to protect my client's rights, the court of appeal determined that the second filing was ineffective to extend my client's statute of limitations. My client was suffering from hydrocephalus which caused symptoms similar to to dementia, so he had no recollection or idea that the attorney he had consulted had served a formal notice of claim.
LESSON LEARNED: Clients must disclose all information about their cases and about what any prior attorneys might have done during the previous representation so that I can effectively protect their rights to proceed with their cases.

The hepatic ducts were destroyed during six subsequent surgeries, and this 35 year old Plaintiff will have to undergo repeat stent procedures once or twice per year for the rest of her life, or until her liver fails, at which time she will require a liver transplant.
Covered under California's MICRA statute, her pain-and-suffering damages are limited to $250,000, however, medical care, both past and present, along with past loss of earnings and anticipated future loss of earnings or capacity to earn are estimated at at least $3million dollars.
