This confinement prohibited Thomas from attending religious services, gaining access to the law library, and participating in industrial therapy. The Court ruled that Patton violated Thomas' Constitutional right to refuse medical treatment.

Tanner further agreed to obtain all requisite technical studies for the SCDEIR. The SCDEIR that Tanner submitted to the City of San Bernardino, however, noted several deficiencies. Montecito sued Tanner alleging that he breached his contract with Montecito when he submitted a SCDEIR that fell below the standard of care. Jury entered judgment in favor of Montecito.
