Gerald Eugene McCarthy

Garry (Gerald) McCarthy has more than 25 years of experience as a litigator in state and federal courts throughout California. He has handled cases in virtually every area of construction in both residential and commercial projects, having tried lengthy cases to verdict on behalf of both the plaintiff homeowners' association and the developer sides. He has represented owners associations as both general counsel and litigation counsel, and has defended developers, general contractors, subcontractors, engineers and design professionals in cases involving alleged design and construction defects.

Mr. McCarthy has extensive experience in all phases of litigation including investigation and discovery, mediation, arbitration and trial. He is actively involved in all insurance issues relating to the construction industry, including working with clients to handle their self-insured retentions (SIRs), providing education and counseling on SIRs and deductible payments, and advising regarding Wrap and OCIP policies. Mr. McCarthy has also worked on behalf of developers and contractors in the processing of land use and entitlement matters, drafting subdivision public reports, and in the preparation and review of construction contracts.

Prior to joining Morris, Sullivan & Lemkul, Mr. McCarthy was a partner with Lewis Brisbois Bisgaard & Smith, LLP.

Mr. McCarthy earned a Bachelor of Arts degree in Economics from U.C.L.A.in 1985, and his Juris Doctor degree from the University of San Diego in 1985. He has sat on the Board of Directors of the California Association of Subdivision Consultants, and has been a member of the Building Industry Association of San Diego, the San Diego County Bar Association, the American Bar Association and the Louis M. Welsh American Inn of Court.
