Section 8, a federal housing program will always be included in the Public Charge rule.

As long as the consulate will not consider that you participated on any fraud by the employer you should be OK receiving a student visa .

"Yes" to both your questions. Until that divorce is finalized you remain in your current H-4? status.

Entirely up to you, however, can file now - all you risk is the fee of the I-485 in case the I-140 ends up not getting approved.
