Kim L. Carter

Kim L. Carter represents California businesses in employment litigation involving claims of race/disability discrimination, sexual harassment, wage and hour disputes, and other labor and professional liability litigation issues.

Ms. Carter successfully litigates for businesses in California state and federal courts and pursues prompt action to effectively resolve disputes at early stages of litigation. She has obtained favorable resolutions of cases for her clients through various ADR methods and dispositive motions. In addition to litigating in federal and state courts, Ms. Carter regularly represents California businesses in administrative matters and hearings before the DLSE, CUIAB, DFEH, and other state and federal agencies. Ms. Carter also conducts audits, workplace investigations, and trainings to ensure her clients are compliant with local, state, and federal laws.

Ms. Carter has participated in numerous trial preparations on race discrimination, wrongful termination, sexual harassment and battery, negligent supervision and hiring, trade secrets, and professional liability matters. She has managed voluminous discovery and also coordinated, conducted and analyzed jury focus groups to assist in the pre-trial process. She defended, as second chair at trial, a high profile child sex abuse case which resulted in a full defense verdict.

In addition, Ms. Carter counsels businesses on preventative measures to avoid litigation or threatened litigation, including negotiation of employment contracts, reviews of general employment policies and wage and hour issues, and drafting employee handbooks. She also conducts internal sexual harassment prevention training and routinely speaks on employment-related issues and updates.

As a native San Diegan, Ms. Carter enjoys staying connected to and involved with the community. As such, she volunteers her time with community focused non-profit organizations. She is currently an advisory board member for the Greater Logan Heights Community Development Corporation and sits on the board for the Worldwide Incident Command Services (WICS), a California Nonprofit Public Benefit Corporation. Ms. Carter also enjoys volunteering at the local law schools as a guest lecturer and mentor to law students.

Ms. Carter graduated from Thomas Jefferson School of Law, magna cum laude. In law school, she received the CALI and Witkin Awards and the Jefferson Medal of Honor for earning the highest grade in the Moot Court Honor Society; Ms. Carter was a judicial extern to the Honorable William V. Gallo (U.S. Federal District Court) and the Honorable Jeffrey B. Barton (San Diego Superior Court); and she volunteered to represent clients at unemployment insurance appeal hearings through the Employee Rights Center with a 100% success rate.
