You are probably prevented from suing from the settlement in that case. This is one pitfall of insurance.

It is possibly malpractice. More facts are required. It is possible the attorney used his best legal judgement which may make it not malpractice.

If it is truly defamation, changing the identity will not protect you if the person is identified. If you are writing Fiction based on true events...
