Is this some how malicious prosecution or legal abuse.. And why is the judge rejecting request for dismissal from both parties

It may be the properties changed owners. It may be possible a proper motion to dismiss the new case may be appropriate.

Review the fee contract between you and the attorney that should spell out how the costs are advanced and reimbursed.

Yes much of those records would be off limit.

An attorney at a Judgment Debtors Exam can help protect your rights. The attorney may also be able to get a continuance.

Firing your attorney would prevent the attorney from working on the negotiations but would probably not result in the attorney in releasing funds....

You could hire an outside copy service or demand digital only copy of records on the newest law.
