You can sue, but are not likely to get more than the amount of the refund.

Yes. The discovery cutoff limits the time to do discovery. It is set by the Court, by stipulation, or by Rule.

Send a “meet and confer” letter to opposing attorney indicating why their responses are improper. If the refuse, file a motion to compel.
