If you are being sued, you must respond. If you are being subpoenaed, you must produce or challenge the subpoena.

Yes you are entitled to a copy of that statement.
I won small claims but in trial de novo I lost. I want to file SC-108 because of hearsay and evidence judge didn't look at.

That would not be the proper form. You can try SC-135. On the facts presented it will not likely be successful.

You could obtain a refund of what you paid and the cost to obtain a new certificate. You might also be able to sue for credit monitoring. Unless...

Not for that reason, no. An attorney can hold off paying a settlement until all relevant bills are resolved.
