Can an amendment that was signed as attorney in fact, when the original trust did not specify that could be done, be valid?

It would not be valid without the specific power in the trust. An estate lawyer might accept a valid case and be paid out of the recovery.

Yes the attorney must do so. But unless that failure caused you harm, a case would not be viable.
