MERWYN J. MILLER, J.D. (Merv) has co-authored two books.  The most recent, Don't Go Broke in a Nursing Home, is a guide for those needing to navigate the difficult road to affording the cost of assisted living, in home care, and skilled nursing for loved also co-authored a legal text book (Understanding California Real Estate Law).  

 

Merv has been an estate planning attorney for almost 40 years and an elder  law attorney for well over 20 years.  In addition to estate planning he assists  families in obtaining Medi-Cal and veterans benefits and often coordinates with the families’ financial advisor.

Merv is an estate planning and elder law attorney with an active law  office in Encinitas, San Diego County, California.  He was admitted to the State Bar of California in 1974 and has been certified by that organization's Board of Legal Specialization as a specialist in Estate Planning,  Trust, and Probate Law. Merv  earned his law degree at California Western  School of Law in San Diego, California, and holds a Masters degree in Financial  Services with an emphasis in Estate Planning.  He is accredited by the Veterans Administration under accreditation number 9055.  He has taught law courses at both public and private colleges and for many years  served as a member of the adjunct faculty of the College for Financial Planning.

 

He wrote legal columns for many local papers, including the largest regional  newspaper in San Diego County (the Blade Citizen and its successor, the North  County Times), and professional journals for 15 years.  He has appeared on the "Wealth Management" television series and has been  listed in "Who's Who in American Law." 


Merv is a frequent lecturer on estate planning  topics to other attorneys and allied professionals including having presented at Continuing Legal Education, Society for  Financial Service Professionals, International Association for Financial Planning,  and Estate Planning Council conferences and the Trusts and Estates Section of the North County Bar Association.

Merv is well known to a host of insurance  and investment firms.  He enjoys traveling, dining on gourmet food and wine, golfing, reading about the American Western Frontier and the Civil War, and coaching youth basketball teams.

Consulted for Estate guidance
Contacted three highly regarded local attorneys for guidance around settling an estate with out-of-state assets and residency. One office didn't return my call. The second office cancelled our initial consult on learning of out-of-state assets. Merv personally contacted me back for details of the estate situation. He followed through with a thoughtful and professional (free) consult despite clear evidence I'd instead need to use an out-of-state attorney. He patiently answered numerous questions, put me at ease, and provided counsel that aided me immensely. When it is time to review or revise my own estate planning Merv will be the first person I call.

Recently revised and updated previous Trust
Mr Miller was so accommodating assisting me previously, I was confident he would be equally helpful . We discussed the pros and cons in layman’s terms. All my concerns were addressed to my satisfaction. His staff was genuinely helpful in all aspects, as well.This was all done following Corvid guidelines and his concern for safety. All Documents were signed digitally, and Notary physically visited my home to finalize. The new Trust documents were delivered FedEx to my home in a professional and organized binder. Can’t thank Mr Miller enough for his kind services and surely recommend for any Estate Planning.

Our family attorney
My father, now deceased for close to a quarter of a century, was meticulous. He spent months looking for an estate lawyer he could trust. He settled on Merwyn a year or so before his passing. He did not have a large estate but he was particular about how he wanted it passed on especially how he wanted it set up for my mother who survived him by more than a decade. Merwyn was successful. It was only natural that my wife and I used Merwyn to establish our trust a decade or so ago. And just this year we had our family trust reviewed and updated to ensure our estate would pass to our direct descendants with as little as possible ending up in federal or state coffers. Neither my wife or I will be around to see how we succeeded, but I have faith, based on my experience with my parents estate, that we will meet our goals with Merwyn’s help.

Mr. Miller, pro bono, graciously helped me try to obtain VA benefits for my ailing husband. VA Claim
Mr. Miller started as a pro-bono to assist in obtaining Aid and Attendance for my, now deceased, mother from the VA. Through no fault of his own to obtain this benefit, the VA forced me and Mr. Miller to enter a contingency agreement allowing Mr. Miller to deal directly with the VA. Mr. Miller was dilligent, forthwright, and kept me informed of all communications he had with the VA. After a long and frustrating experience with the incompetence of the VA, Mr. Miller prevailed and a benefit was awarded. Thank you Mr. Miller.

A God-send for this Son of a Veteran
Mr. Miller and his staff expertly handled the complex, intricate filing for a Veterans' Aid and Attendance pension benefit for my elderly father. This benefit - though it took a seemingly very long time to be approved - turned out to be the sole way our family could possibly afford proper care for a brave vet who had entered the murky waters of dementia. Miller and his staff kept me briefed throughout the process and were instrumental in coaching me what to expect and when. And they were right!
