Real Estate, Land Use and Planning. The Loftin Firm represents a broad range of clients with a diverse array of real estate, land use and planning matters. Our clients range from private real estate developers and land owners (both small family developers and large institutional development companies) to public municipalities. We bring a breadth of experience in all areas of real estate and land use to effectively manage and advise our clients.
Homeowner Associations/Common Interest Developments. The body of law governing homeowners associations is complex and highly regulated by various State agencies. The Loftin Firm acts as general counsel or HOA counsel to such associations throughoutCaliforniaand can provide guidance on the formation, operation and enforcement matters that face any association, whether developer-controlled or resident-controlled.
Major changes have occurred in the law governing common interest developments necessitating changes to Operating Documents such as bylaws and CC&Rs, along with the crafting of appropriate Policies and Procedures for the enforcement of association dues obligations and the Operating Documents. The Firm is proactive in assisting its common interest development clients (most, but not all of the homeowners associations fall into this category) to comply with the rapidly changing operational laws to avoid potential litigation.
Corporate, Business and Finance. Within our corporate, business and finance practice group, we provide a wide range of legal support for general business and financing transactions for individuals and businesses of all sizes, from initial formation through and including operations of a business enterprise, including drafting and counseling businesses regarding their contracts, to financing and other complicated transactions.
