If he doesn't pay the rent, you can give him a 3 day notice and then afterwards file an unlawful detainer action (eviction). If you are unfamiliar...

.1. Yes if they are not a party.
2. Yes it can be appealed by the defendant if they lose.

Verbal notice is not sufficient. Written notice is required.

If the tenant intentionally caused the problems, the landlord can deduct it from the tenants.

If they didnt pay the rent yet, you can start with the 3 day notice.
