In 2020 I filed a PC 1001.95 Judicial Diversion motion, the first motion of it's kind filed on a DUI ... charge in that Court. It was granted by the Judge placing my client on diversion, the successful completion of which would result in a dismissal of all the charges without there ever being a conviction. My client successfully completed the terms of diversion and his case was dismissed. I believe it is the only case in that court where a DUI was dismissed by this statute and procedure.

NOTE: At the conclusion of the trial members of the Jury hung waited in the hallway to speak with me. They informed me that they learned a lot during the trial and they will never blindly trust breath test machine results again now that they were educated as to all the potential issues that can cause them to give unreliable and inaccurately high readings.
