OUTCOME: Charges completely dismissed!

Prior to hiring me the client paid his traffic ticket without going to court and was convicted of failing to stop at a stop sign. The conviction led to a negligent operator driver license suspension ba ... sed on attaining too many DMV points. First, I successfully motioned to withdraw the conviction and put the case back on calendar. Then, at trial I was able to get the traffic ticket completely dismissed removing the DMV point and having the Court refund my client for the payment he previously made. The success of my work removed the negligent operator driver license suspension issue.

OUTCOME: All Charges completely dismissed!

Client Charged with DUI VC 23152A and VC 23152b. a .08 BAC or higher as well as an allegation of having a .15 or higher BAC (alleged BAC was .21,,almost three times the legal limit). Through the ... course of the Court and DMV hearings I subpoena’d and did discovery requests for video recordings, dispatch calls, and other evidence. The arresting agency responded that they were not going to comply the subpoena I issued, apparently hoping I would just give up. I did not. Instead I put the ball in motion to instigate an action against the arresting agency for their blatant non-compliance with the subpoena. I subsequently received the video and dispatch recordings which were very helpful and proved that there were many inaccuracies and false statements in the police report. After winning the DMV hearing I then proceeded to the criminal case (which was “late-filed” by the Prosecutor). Client was a military veteran. Although I felt like I had a good case to win at trial based on what I discovered and uncovered during my work-up on the case, I filed a misdemeanor military diversion motion which was granted and successfully completed. All charges completely dismissed and arrest record sealed! (Ventura, CA)

This was a negligent operator hearing for a client who is in their 80's and was involved in a car accident. Officer's arrived at the scene and reported to the DMV potential issue with driving. DMV se ... t a negligent operator re-examination hearing to determine if they were going to take action against my client's driver license (ie. suspend the driver license). At the conclusion of the hearing, the hearing officer agreed not to suspend my Client's driver license as long as they passed a driver test. After further communication with hearing officer I was able to persuade the hearing officer that a driver test should not be required in this case. The Hearing Officer subsequently agreed and my client's driver license remains valid without the need of additional testing.

Represented Petitioner on an Elder Abuse Restraining Order matter. Client was renting a room out to someone who was harassing, bullying and controlling (etc) him. The other party was refusing to move ... out and my client felt like a prisoner and scared to be in his own home. As a result of our hearing/trial, the Judge granted the Restraining Order including a move out order! (ie. the other party had to move out of my client's home ). Very happy, grateful and relieved client who can now live in his own home with peace of mind.
