OUTCOME: Trial Court Decision Affirmed by California Court of Appeal

The trial court granted our motion for summary judgment against the plaintiff who was attempting to enforce a government loan that had been assigned to him. The plaintiff appealed to the California Co ... urt of Appeal arguing that dismissing the case against the plaintiff seriously infringed upon the right of the U.S. Government to assign cases involving government loans to third parties to pursue the borrowers. We strongly disagreed, and the Court of Appeal, after we filed our brief and made oral arguments at the hearing, affirmed the trial court's dismissal of the case, and awarded our client attorney fees.

OUTCOME: We settled the case for the entire amount of the damages suffered by our client-in excess of $300,000.

Our client purchased a property for purposes of operating a fast food restaurant on the property. Our client's property was located next door to a gas station. Years after the purchase of the property, ... our client attempted to sell the property, but the buyer backed out of the transaction because he alleged that the property was contaminated by the gas station next door. As a result, our client wound up having to sell the property to another buyer for about $300,000 less than the deal that collapsed because of the contamination. The gas station denied liability.

Pizza Restaurant Chain Investors

OUTCOME: $1,600,000 judgment, including punitive damages, and our clients now own the disputed restaurant.

Our clients invested a substantial amount of money in a well-known Pizza chain restaurant, but were not represented by an attorney at the time, so the investment was not appropriately documented. The m ... anager of the restaurant, who had solicited our clients, used the absence of documentation to exclude our clients from the business, and did not share profits with them despite the fact that the restaurant was extremely successful. At trial, we obtained a large judgment against the restaurant manager who then put the company in a Chapter 11. We then moved our attention to the bankruptcy court where we were able to remove the manager as owner of the company. Finally, our clients were then able to complete the Chapter 11 by having a Chapter 11 Plan confirmed in court, and are now successfully and happily running the restaurant.

Successful Appeal of Unlawful Detainer

OUTCOME: Our client maintained the lease agreement, saved his business, and the reversal at the Court of Appeals helped him save hundreds of thousands of dollars.

Our client ran a large business until his landlord obtained an unlawful detainer (eviction) judgment against him. Our client was about to be evicted. His business would have been destroyed. We brought ... a motion in front of the trial judge to set aside the forfeiture of our client's lease based upon our contention that the judgment (entered by the same judge to whom we brought our motion) was unjust and created an undue hardship for our client. The Motion was granted! Then we appealed other aspects of the judgment to the Court of Appeals, and much of the original judgment was reversed.

Escrow Company Negligence

OUTCOME: Each defendant contributed to a settlement worth in excess of $650,000.

Our clients were able to refinance their house so that they could use that money to stop the foreclosure of commercial property they owned. The escrow company agent in charge of sending the money to th ... e foreclosure trustee so that the foreclosure-days away-would be stopped, was rushing to get away for a three day vacation, and wound up wiring the funds to the wrong account. The property was sold at a foreclosure sale to a third party. We sued the escrow company, but escrow companies, amazingly, are not required to carry insurance policies for these types of losses. We, therefore, wound up suing other related parties.

A third party desperately wanted to own property owned by our clients. Towards that end, he purchased a tax lien on the property, and commenced foreclosure proceedings. We sued both parties based upon a "collusion" theory, and further based upon the allegation that they chilled the bidding process.

OUTCOME: Our Motion to Vacate the Judgment was granted based upon a unique argument made by us that our client's former attorney had abandoned his case.

Our client retained an attorney who did not devote enough time to our future client's case. A motion for summary judgment was entered against our client for approximately $350,000.
